Wyder Terms of Service

 

1. Who we are and what these terms do

These Terms of Service (“Terms”) govern your access to and use of the Wyder mobile application and related websites (the “App” and “Services”), provided by the undertaking with the tradename Wyder (“Wyder”, “we”, “us”).

 

By creating an account or using the Services you agree to these Terms and to our Privacy Policy.

 

The Services help athletes plan workouts, discover or generate routes, and connect/match with others for joint activities. Wyder does not record your activities or provide turn-by-turn navigation hardware; those functions may be provided by third-party devices/apps you choose to connect with.

2. Eligibility and accounts

You must be 13+ to use the Services. If you are under the age of majority where you live, you represent that a parent/guardian has reviewed these Terms and consents to your use of the Services. You must provide accurate account information and keep it up to date. You are responsible for safeguarding your credentials and all activity under your account. We may refuse, suspend, or terminate accounts that violate these Terms or applicable law.

Identity caution. Wyder does not verify users’ true identities. Exercise caution when arranging meet-ups; meet in public places; tell someone where you are going; and use the in-app reporting tools if you have safety concerns.

3. User conduct and safety

You agree not to: (a) harass or endanger others or incite to violence; (b) post illegal, hateful, or IP infringing content, or non-consensual imagery; (c) attempt to scrape, reverse engineer, or circumvent security; (d) use the Services for advertising or spamming; (e) misrepresent your identity, fitness, or intentions; (f) engage in dangerous conduct on routes or during activities related to the Services.

Notice & takedown. If you believe content violates the law or these Terms, use the in-app report or email legal@wyder.io. We may remove content, restrict features, or suspend accounts in case of violation of the law or of these Terms.

Statement of reasons. If we restrict content or accounts, we will issue a statement of reasons (what was restricted, why, the rule or law applied, and how to contest). You may appeal a moderation decision within 6 months through the in-app appeal flow or by emailing legal@wyder.io with “Appeal” in the subject. We aim to decide appeals within 14 days.

4. User content and licences

You retain ownership of content you upload (e.g., profile info, photos, descriptions, routes you create). You grant Wyder a worldwide, non-exclusive, royalty-free licence to host, display, and process your content to operate and improve the Services. You are responsible for obtaining any third-party rights needed for the content you share.

You may not upload content that infringes others’ rights. We may remove or disable access to allegedly infringing content and, where appropriate, terminate infringers.

Repeat-infringer policy. Accounts that receive three or more substantiated infringement notices within 12 months may face escalating measures up to termination, taking into account counter-notices and context.

Counter-notice. If you believe content was removed in error, you may submit a counter-notice with sufficient detail. Unless required otherwise by law, we may reinstate content if the dispute is resolved or the notice appears unfounded.

5. Third-party integrations and links

You may link your third-party accounts or devices (e.g., Strava, Garmin) to import data or sync activities. Those services are governed by their own terms and privacy policies. Integrations can change, break, or be withdrawn at any time by the third party (for example, Strava may terminate or change API access and require deletion of Strava data after termination; continued use may be deemed acceptance of changes). If an integration is withdrawn, some Wyder features may be limited or unavailable.

Attribution & display. Where data originates from Garmin, Wyder will follow Garmin’s developer/brand guidelines, which may require visible Garmin attribution on top-level screens (e.g., key summary screens), secondary screens, exports/reports, and views showing aggregated or derived metrics. You acknowledge such attribution may appear next to your metrics when they come from Garmin devices.

Strava data use limitations. Where you connect Strava, Wyder will: (i) only display your Strava activity data to you within Wyder; (ii) not use Strava API data to train AI/ML models; and (iii) comply with Strava’s API terms regarding deletion upon termination.

6. Subscriptions, trials, and billing

Wyder offers a freemium model, i.e. free services with optional paid subscriptions. Details of features, prices, and any limits (e.g., number of workouts per month) are shown in-app.

  • Auto-renewal. Subscriptions renew automatically at the end of each term unless you cancel in your store settings before renewal. We’ll notify you of price changes in advance and give you a chance to cancel.

  • Trials & promos. If you start a free trial, your plan may automatically convert to a paid subscription at trial end unless you cancel within the term that will be clearly stated when registering for the trial.

  • Taxes. Prices include applicable taxes and all other costs.

  • Third-party stores. If you subscribed via the Apple App Store or Google Play, their terms govern billing and refunds.

 

Pre-contract information. Before you purchase, we will show (i) the total price per billing period (including taxes/fees), (ii) renewal cadence and trial end date/time (if any), (iii) how to cancel and by when to avoid renewal, and (iv) the minimum contract duration. You will confirm that ordering implies an obligation to pay.

7. Consumer right of withdrawal (EU/EEA)

If you are an EU/EEA consumer purchasing a digital service at a distance, you generally have 14 days to withdraw. However, you lose this right once you: (a) give express consent to immediate performance and (b) acknowledge you will lose the right after performance begins (we’ll collect both in-app before activating premium features).

If you withdraw within 14 days before performance begins, we will refund you using your original payment method. Where partial performance occurred with your consent, we may charge a proportionate amount for the period used, as permitted by law.

How to withdraw. You can withdraw by (i) using the in-app “Withdraw from purchase” button, or (ii) emailing support@wyder.io with your account email and purchase details, or (iii) sending the model form below to support@wyder.io. We will confirm receipt without undue delay.

Refunds. If eligible, refunds are issued within 14 days of your notice using the original payment method, less any proportionate amount for the period used (calculated as: price × (days of premium used / days in billing period)).

8. Changes to the Services or Terms

We may modify features, impose reasonable technical limits, or discontinue parts of the Services. We may update these Terms (e.g., to reflect legal or product changes). We’ll notify you in-app or by email for material changes. Continued use after the effective date constitutes acceptance.

9. Health, safety, and assumption of risk

Outdoor and endurance activities carry inherent risks (collisions, weather, terrain, navigation errors, health incidents). By using Wyder you accept these risks and agree to use your judgment, obey traffic laws, wear appropriate safety equipment, and consult a physician about your fitness.

 

Wyder is not a medical device and does not provide medical advice. We recommend you maintain appropriate personal insurance for sporting activities.

Nothing in this section excludes liability for defects in the Services where such exclusion is prohibited by law.

10. Platform availability and support

The Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation. We may suspend access for maintenance, security, or legal reasons. Support channels are listed in the App.

11. Intellectual property

The Services, software, and brand assets are owned by Wyder or its licensors and are protected by IP laws. You receive a personal, revocable, non-transferable licence to use the App per these Terms. You may not copy, modify, reverse engineer, or create derivative works from the Services except as permitted by law.

12. Data protection

Your personal data is processed as described in the Privacy Policy (which forms part of these Terms). Among other things, our Privacy Policy (https://www.wyder.io/privacy) explains consents, visibility controls, downloads/deletion, and third-party integrations.

You can export your data and delete your account in-app at any time; residual retention may apply where required by law (see Privacy Policy).

13. Liability

Nothing in these Terms limits or excludes liability where such limitation/exclusion is prohibited by law, including for death or personal injury caused by our fault, fraud, or where liability cannot be limited under applicable consumer law.

Subject to the above, and to the extent permitted by law:

  • Indirect damages (e.g., lost profits, loss of data, or business interruption) are excluded; and

  • Our aggregate liability for the Services is limited to the amount you paid to Wyder in the 12 months preceding the event giving rise to liability (or €25 if you used only the free tier).

 

These limits don’t affect statutory consumer rights and won’t apply to intent or gross negligence under Belgian law.

14. Indemnity for misuse

You agree – only to the extent permitted by law – to indemnify Wyder for third-party claims and costs (including reasonable legal fees) directly arising from (i) your unlawful use of the Services, (ii) your content that infringes third-party rights, or (iii) your intentional or negligent breach of these Terms, in each case only to the extent caused by your fault. This indemnity does not apply to normal, permitted consumer use of the Services and does not reduce any rights you have under consumer law.

15. Termination

You may delete your account at any time in the App. We may suspend or terminate your access if you materially breach these Terms, create risk or legal exposure for us or others, or if required by law. After termination we may retain minimal records required by law and will process deletion per our Privacy Policy.

16. Governing law and jurisdiction

These Terms are governed by Belgian law. If you are a consumer resident in the EU/EEA/UK, you may bring legal proceedings before the courts of your own domicile. For other customers only the courts of Brussels have jurisdiction. Nothing in this clause deprives you of mandatory protections under your local consumer law.

18. Miscellaneous

Severability. If any clause is invalid, the remainder stays in effect.

Assignment. No assignment without consent (except we may assign to an affiliate or in connection with a merger/acquisition).

Force majeure. We’re not liable for events beyond our reasonable control (e.g., outages or third-party API withdrawals).

Entire agreement. These Terms and the Privacy Policy form the entire agreement between you and Wyder regarding the Services.

Summary. A short, plain-language summary of key rights and obligations is available in-app and on our website; if any conflict exists, these Terms prevail.
